What are the strengths and weaknesses in regulating AI?

The goals of regulating AI

For example, soft law can establish ethical principles or best practices for designing or deploying AI systems. Soft law can also encourage voluntary compliance or self-regulation by different stakeholders in the AI field.
  • Hybrid approaches: This refers to the combination or integration of hard law and soft law methods for regulating AI. Hybrid approaches can provide a balanced and comprehensive framework for regulating AI. For example, hybrid approaches can use hard law to set the minimum standards or boundaries for acceptable or unacceptable AI behaviour. Hybrid approaches can also use soft law to complement or supplement hard law by providing more detailed or specific guidance or recommendations for different contexts or scenarios.


The challenges of regulating AI


Despite its strengths, regulating AI also faces several weaknesses or challenges that need to be addressed. Some of these challenges are:


  • The complexity and uncertainty of AI: Regulating AI is difficult because AI is a complex and uncertain phenomenon that is constantly evolving and changing.
